These Terms and Conditions govern your use of the website www.amtreasure.com, operated by Aušra Mačiulaitienė.  Throughout the site, the terms “we,” “us,” and “our” refer to Aušra Mačiulaitienė and brand AM TREASURE. Please read these Terms and Conditions carefully before accessing or using our website. By accessing or purchasing from our website, you agree to comply with and be bound by these Terms and Conditions. If you do not agree to these terms, you must not access the website or use our services.

1. FORMATION OF CONTRACT

1.1 A contract for the purchase of goods between you (the "Buyer") and AM TREASURE (the "Seller") is formed when you complete and submit an order through our online store, having reviewed and accepted these Terms and Conditions.

2. SELLER'S RIGHTS

2.1 The Seller reserves the right to temporarily or permanently suspend operations of the website without prior notice to the Buyer in cases of significant circumstances.

2.2 If the Buyer attempts to harm the operation, stability, or security of the website or violates their obligations, the Seller has the right to limit or suspend access to the website without warning.

3. SELLER'S OBLIGATIONS

3.1 The Seller agrees to provide services via the online store in accordance with these Terms and Conditions.

3.2 The Seller is committed to delivering purchased goods to the delivery address specified by the Buyer.

3.3 In case of unforeseen circumstances preventing the Seller from delivering ordered goods, the Seller has the right to terminate the contract, providing notice to the Buyer. The Seller may offer a similar product in lieu. If the Buyer declines, the Seller will refund the payment within 5 working days.

4. BUYER'S RIGHTS

4.1 The Buyer has the right to purchase goods from the online store under these Terms and Conditions.

4.2 The Buyer may return purchase within 14 calendar days from the date of delivery by notifying the Seller in writing.

4.3 The right to return as described in Section 4.2 applies only if purchased item is unworn, undamaged, and otherwise unaltered. The original item, packaging and intact documentation are required for returns. Gift cards are not eligible for return. Custom made jewellery can be returned, however, 30 % of the custom made jewellery cost will be deducted for a refund as a recycling fee.

5. BUYER'S OBLIGATIONS

5.1 The Buyer must pay for the purchased goods and accept them per these Terms and Conditions.

5.2 If the Buyer refuses to accept the goods upon delivery without valid reason, the Buyer must cover the return shipping costs upon the Seller's request.

5.3 Upon delivery, the Buyer is required to inspect the condition of the package and items with the delivery person.

5.4 By using the online store, the Buyer confirms acceptance of these Terms and Conditions.

5.5 Due to potential variations in computer screen settings, the colors, shapes, or other attributes of products displayed on the website may differ slightly from the actual product. The colors, shapes, or other attributes of custom made jewellery may differ slightly from the corresponding products displayed on the website.

6. PRICING

6.1 All prices displayed on the website are in Euros and include VAT. The total price will include applicable delivery charges upon order confirmation.

7. ORDERING AND PAYMENT

7.1 The Buyer selects products from the online store and adds them to the shopping cart. After reviewing the order, the Buyer must enter personal information necessary for order processing.

7.2 Buyer can order a custom made jewellery by filling custom order form. The Buyer is contacted using the contacts specified by the Buyer, the order is detailed, a payment invoice is prepared and sent to the Buyer via email.

7.3 Payment can be made using electronic banking services from various banks and via Visa/MasterCard. Payments are processed through a secure payment platform.

8. DELIVERY OF GOODS

8.1 The Buyer must provide an accurate delivery address when placing an order.

8.2 The Buyer must personally accept the goods. If the Buyer cannot do so, and the goods are delivered to the specified address, the Buyer forfeits the right to claim against the Seller for misdelivery.

8.3 The Seller will deliver goods based on the timelines specified in shipping policy.

8.4 The Seller is not responsible for discrepancies in product colors, shapes, or other parameters due to monitor settings.

9. RETURN POLICY

9.1 High-quality items can be returned within 14 days of receipt.

9.2 To return items, the following conditions must be met:

• The item must be in its original, undamaged packaging (not applicable for faulty items).

• The item must not be worn, damaged, or altered.

• The quality certificate must be intact and unaltered (not applicable for faulty items).

• The item must be returned in the same condition as received (not applicable for faulty items).

9.3 The Seller reserves the right to refuse returns if the return conditions are not met.

9.4 All returned items are subject to verification for authenticity, and refunds will only be processed once the items are confirmed original. Refunds may take up to 14 working days.

9.5 The exchanges for the jewellery is not applicable. However, one complimentary ring resize up to one full European size by the quarter, half, or full size can be requested by the Buyer. If the ring resize request is outside of one full size, the Buyer may need to follow return policy and re-order the ring. 

 

10. FINAL PROVISIONS

10.1 These Terms and Conditions are governed by the legal acts of the Republic of Lithuania.

10.2 Any disputes arising from these Terms will be resolved amicably. If no resolution is reached, disputes will be settled according to applicable laws.

10.3 The Seller is exempt from liability for non-fulfillment of these Terms due to unforeseen circumstances (Force Majeure).
